As a Section 8 Company, MFF operates exclusively for the promotion of cultural heritage, folk arts, music, education, and community welfare, with all income and surplus directed towards these objectives in accordance with its Memorandum of Association (MOA) and Articles of Association (AOA).

2. Acceptance of Terms

By accessing or using the website located at www.malangfolkfoundation.org ("Website"), you ("User", "you", "your") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, please discontinue use of this Website immediately.

 

These Terms constitute a legally binding agreement between you and MFF under the Indian Contract Act, 1872.

3. Nature of the Organisation

MFF is a not-for-profit organisation. All monetary contributions, donations, and programme fees received through this Website are used solely for the furtherance of MFF's cultural and social objectives as defined in its MOA. MFF does not distribute profits, dividends, or surplus to any member, director, or shareholder.

4. Website Use

4.1 Permitted Use

You may access and use this Website for the following purposes:

  • Obtaining information about MFF's programmes, initiatives, and events.

  • Making voluntary donations or programme-related payments.

  • Registering for events, festivals, retreats, and cultural programmes.

  • Downloading publicly available resources, publications, and reports.

  • Use the Website for any unlawful purpose or in violation of applicable Indian law.

5. Donations and Financial Contributions

5.1 Voluntary Nature

All donations made through this Website are entirely voluntary. MFF does not offer any goods or services in exchange for donations.

5.2 Non-Refundability

Donations made to MFF are generally non-refundable, as they are immediately applied towards ongoing cultural and community programmes. In the event of a technical error resulting in duplicate or erroneous transactions, please contact us at info@malangfolkfoundation.org within 7 working days. Verified cases will be addressed at MFF's sole discretion.

5.3 Tax Benefits

Donations to MFF may be eligible for tax exemptions under applicable provisions of the Income Tax Act, 1961, subject to MFF's registration status at the time of the donation. MFF shall provide receipts and certificates as required. It is the donor's responsibility to verify current exemption status with their tax advisor.

5.4 Use of Funds

All funds received are used exclusively for MFF's stated objectives — including folk music preservation, artist fellowships, cultural festivals, heritage conservation, education programmes, documentation, and community engagement — in accordance with MFF's MOA and applicable law.

5.5 Payment Security

MFF uses third-party payment gateways that are PCI-DSS compliant. MFF does not store your payment card details on its servers. All financial transactions are encrypted using industry-standard SSL/TLS technology.

6. Programme Registrations and Event Participation

6.1 Registration

Registrations for MFF's events, retreats, festivals, and programmes (including the Rajasthan Kabir Yatra, Kahat Kabir Retreats, Ajoo Gooja, and similar programmes) are subject to availability and MFF's acceptance.

6.2 Cancellations and Refunds

  • Cancellations made by the participant more than 14 days before the event may be eligible for a partial refund at MFF's discretion, less any administrative or processing costs already incurred.

  • Cancellations within 14 days of the event are generally not eligible for a refund.

  • If MFF cancels or postpones an event due to unforeseen circumstances (including natural disasters, government orders, or force majeure), registered participants will be notified and offered either a transfer to a future edition or a partial refund.

6.3 Conduct

Participants in MFF's programmes are expected to conduct themselves respectfully and in alignment with the spirit of cultural exchange and community values. MFF reserves the right to remove any participant whose conduct is disruptive, disrespectful, or harmful.

7. Intellectual Property

7.1 Ownership

All content on this Website — including but not limited to text, photographs, illustrations, videos, audio recordings, logos, graphics, programme descriptions, archival materials, and design elements — is the intellectual property of Malang Folk Foundation or its licensed contributors, and is protected under the Copyright Act, 1957, and applicable Indian intellectual property laws.

7.2 Permitted Use

You may view and print content from this Website for personal, non-commercial reference only, provided that:

  • All copyright and proprietary notices are retained

  • No content is modified or altered

  • No content is used for commercial purposes without prior written consent

7.3 Artist Content

Content created by folk artists, musicians, or cultural practitioners documented through MFF's programmes belongs to those individuals and communities. MFF holds archival and publication rights only as agreed with the respective artists. Unauthorised commercial use of artist content is strictly prohibited.

8. Third-Party Links

This Website may contain links to external websites, social media platforms, or partner organisations. MFF does not endorse, control, or take responsibility for the content, privacy practices, or accuracy of any third-party website. Your use of third-party links is at your own risk.
